Minimum Wage Act (NY State Labor Law, 661)

2018 Labor Compliance Laws for New York State and NYC

The state of New York has been on a recent push to make the state more business friendly with tax incentives and subsidies. This should make the state more attractive for businesses looking for a place to set up shop. New York also has very strict anti-discrimination and workers’ rights laws that are required to be displayed on the New York State labor law poster. Explaining Labor Posting Compliance for New York and NYC

Because labor posting compliance in New York can get complicated, many human resource managers and business owners in New York have a hard time knowing what exactly they need to display to remain compliant. The issues stem from minimum wage postings, to insurance carrier notices.Let’s begin with the New York minimum wage question. While the New York state minimum wage for 2018 is $11.10, Long Island, Westchester, and New York City each have their own respective minimum wage increase for 2018. New York City even has two separate minimum wages, one for employers with 11 employees or more, and one for 10 employees or less. See the following table for the minimum wage increases for 2018 in New York.

New York State Paid Family Leave Poster, Effective January 2018

Beginning January 1st, 2018, New York state will roll out what will be at the time the most extensive Paid Family Leave law in the country. There are still provisions being added to the law that will likely change what will be required to display on the states’ labor poster. The New York State Paid Family Leave Law will be a mandatory posting requirement in 2018.

Governor Andrew Cuomo signed the law in 2016, and while other states such as Washington will have an even more comprehensive plan, The New York State Paid Family Leave will be the first to be enact such a wide array of protections for New York state employees. The law is designed so families can bond with a new child, either a new baby or an adopted child, to help with familial burden when a family member is called to active military service, or to care for a family member with a severe health condition.
The full amount of paid family leave will be phased in slowly over the course of four years. Below is a chart with the allowed duration of paid leave that is scheduled to take place:

New York Minimum Wage

There’s a new labor law poster on the New York minimum wage. It provides that employers should pay non-tipped workers at least $11.00 and $8.30 for tipped employees. This is however for large employers with more than 11 workers. Those with 10 or less workers will on the other hand pay at least $10.50 for non-tipped workers and $7.95 for tipped employees.
This is not for all though.Employers in Long Island and Westchester counties are expected to be paying at least $10.00 for non-tipped workers and $7.55 for tipped workers. Employers in other parts of the state including; Amityville, Belle Terre, Bellport, Brightwaters, Brookhaven, Dering Harbor, and Glen Cove among others are expected pay non-tipped workers at least $9.70 and $7.35 for tipped workers.
According to the new New York minimum wage labor law poster, employers are expected to give an additional overtime pay one-and-half times the usual rate for any hours worked over 40. The overtime pays are entitled to employees within the state, regardless of which part of the state they hail or the size of the employing agency or organization
The New York minimum wage rate paid to non-tipped workers is expected to rise by $2.00 each year. By end of the year 2018 this should have reached $15.00. The hourly pay paid to tipped workers will also rise by $1.50 and by end the year 2019 this will be $15.00. Workers in Long Island and Westchester will on the other hand get an additional $1.00 annually till 2021.
The New York minimum wage increments is a matter of concern to 2.3 million or so workers within the state. This is the lowest amount permitted by law or by any special agreements such as those negotiated by labor unions. It is the price floor below which workers cannot sell their labor. The rates are protected by the Fair Labor Standards Act (FLSA).Concerning the family leave Act, employees working within the state are also entitled a paid 12-week leave once every year.
This applies to workers who have worked for six months and above.The leave should serve as a relief to low-income workers who do not have job security and who are often prohibited from accessing any other form of leave, even if it’s unpaid. It will also help promote fairness especially to those likely to quit their jobs to take care of a new-born, a family member with serious health condition or in the event a spouse is called to active military service.
